Terms of Service

By accessing or using the BadgeOut web application (the "Service"), you agree to these Terms of Service ("Terms").

Use of the Service

You agree to use the Service only for lawful purposes and in a way that does not interfere with or disrupt the Service or other users.

You may not:

  • Attempt to gain unauthorized access to the Service
  • Abuse, scrape, or reverse-engineer the Service
  • Use the Service in violation of applicable laws

Accounts

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

You agree to provide accurate and current information and to keep your account information up to date.

Customer Data

"Customer Data" means all data, content, and information that you or your users submit to the Service. As between you and BadgeOut, you own your Customer Data.

You grant BadgeOut a limited, non-exclusive license to host, process, and transmit Customer Data solely to the extent necessary to provide, maintain, support, and secure the Service. We will not access, use, or disclose Customer Data for any other purpose except as required by law or as described in our Privacy Policy.

We may create de-identified and aggregated data derived from Customer Data that does not identify you, your users, or any individual, and may use that data to analyze, improve, and develop the Service, including its AI-assisted features. We will not use identifiable Customer Data to train machine learning models.

Your organization's administrators may export Customer Data at any time while your account is active. Following termination, we will delete Customer Data from our production systems within a reasonable period, except where retention is required by law.

Payments & Subscriptions

Some features of the Service require payment.

  • Payments are processed through Stripe
  • Fees, billing cycles, and renewal terms are disclosed at the time of purchase
  • Subscriptions may renew automatically unless canceled

All payments are non-refundable unless required by law or explicitly stated otherwise.

Intellectual Property

The Service, including its design, code, documentation, and branding, is owned by BadgeOut and protected by intellectual property laws. Customer Data is excluded from this provision.

You are granted a limited, non-exclusive, non-transferable right to use the Service while your account is active.

Service Availability

The Service is provided on an "as is" and "as available" basis. We do not guarantee that the Service will be uninterrupted, error-free, or always available.

We may modify or discontinue features at any time.

Limitation of Liability

To the maximum extent permitted by law, BadgeOut shall not be liable for any indirect, incidental, consequential, or special damages arising out of or related to your use of the Service.

Your sole remedy for dissatisfaction with the Service is to stop using it.

Termination

We may suspend or terminate your account if you violate these Terms or misuse the Service.

You may stop using the Service and cancel your account at any time.

Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
